Python Safety, Inc. filed suit on June 18, 2014 against Ty-Flot, Inc. in the United States District Court for the Northern District of Georgia. The suit alleges patent infringement, trade dress infringement, and unfair competition.
Python Safety owns US Patent No. 8,646,768. The ‘768 Patent describes a novel quick spin holder for tools and accessories, and methods for using the novel holder. In its complaint, Python Safety accuses Ty-Flot of infringing the ‘768 Patent with its Grip-Fit line of tool holders. Furthermore, Python Safety accuses Ty-Flot’s hard-hat tether, safe bucket, single tool holster, and dual tool holster of infringing Python Safety’s trade dress. Python Safety also seeks redress for unfair competition.
Python Safety seeks an injunction and damages. Additionally, Python Safety requests that the court order Ty-Flot to destroy all products found to be infringing. Finally, Python Safety seeks punitive damages.
