A 52-year-old Massachusetts worker who will "never walk normally again" after falling off a roof in 2015 was awarded $750,000 from his employer by a Berkshire Superior Court jury Thursday, reports The Berkshire Eagle.
Jose Hernandez was working for Richard Shove and his business, Rick's Complete Lawn Landscaping Service, shoveling snow off the roof of a commercial client when the fall occurred.
He landed on his feet and the impact fractured one heel bone into multiple pieces. The injury limits Hernadez's ability to continue his profession and sustain himself, his lawyer argued, deeming the award appropriate because Shove failed to supply Hernandez workers’ compensation insurance, instead claiming he wasn't an employee at the time of his injury.
The jury didn't buy the employer’s claim. The award could be subject to appeal but none has been filed as yet.
